Terms of Service

1. Definitions

"Service" refers to the PricePress web application and all associated features, APIs, and documentation. "User" refers to any individual or entity that accesses or uses the Service, including without limitation licensed insurance adjusters, adjusting firms, insurance underwriters, insurers, brokers, legal professionals, estate practitioners, and any other licensed or credentialled professional using the Service in a professional capacity. "Third-Party Market Data Providers" refers to external retail aggregators, merchant APIs, and pricing intelligence services integrated into the Service. "Industry-Standard Claims Software" and "Major Estimating Platforms" refer to third-party insurance estimating and claims management software commonly used in the adjusting industry. "PricePress" refers to PricePress, a company incorporated in Jersey, Channel Islands.

2. Acceptance of Terms

By accessing and using PricePress, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is intended for professional use by licensed or credentialled professionals including, but not limited to, insurance adjusters, adjusting firms, insurance underwriters, insurers, brokers, legal practitioners, estate professionals, and their authorised employees and representatives. Use of the Service constitutes your representation that you are acting in a professional capacity and that you are legally authorised to use the Service for your intended purpose. Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

3. Description of Service

PricePress provides an automated pricing engine that acts as a pass-through workflow tool, matching item descriptions with live retail pricing data sourced from Third-Party Market Data Providers and External Retail Aggregators via our Proprietary Retail Routing technology. The Service generates formatted output documents including Replacement Cost Value (RCV) estimates, depreciation schedules, source attribution, and related reports for professional use cases including, but not limited to, insurance claims assessment, pre-loss policy underwriting, asset valuation, estate and probate administration, and related professional workflows. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

4. Billing and Subscriptions

Our order process is conducted by our online reseller Dodo Payments. Dodo Payments is the Merchant of Record for all orders and provides customer service inquiries and handles returns. By purchasing a subscription, you agree to Dodo Payments' terms and conditions. Subscriptions are billed in advance on a monthly basis and are non-refundable. Additional search packs may be purchased as one-time add-ons subject to availability and active subscription status.

Where a promotional or conference rate has been offered, any associated price lock applies solely to the subscription tier and feature set available at the time the promotional rate was confirmed. New features, modules, or add-ons introduced by PricePress after the date of a promotional commitment may be made available at an additional charge and are not included in any previously agreed rate unless explicitly stated in writing by PricePress.

5. Usage Limits and Fair Use

Accounts are strictly limited to the number of user seats and monthly search quotas associated with their subscription tier. Specifically:

• Account sharing and credential sharing between individuals is strictly prohibited.
• Automated scraping, programmatic access, or any attempt to bypass system rate limits or quota enforcement is grounds for immediate account termination.
• Search quotas reset on each billing cycle. Unused searches do not roll over.
• PricePress reserves the right to throttle or suspend accounts that exhibit abusive usage patterns.
• Use of the Service to knowingly inflate, fabricate, or misrepresent item values for the purpose of submitting fraudulent insurance claims or any other fraudulent purpose is strictly prohibited and constitutes grounds for immediate account termination and referral to relevant authorities.

6. Data Sources and Third-Party Providers

The Service retrieves pricing data from multiple Third-Party Market Data Providers and External Retail Aggregators. You acknowledge that:

• Pricing data is sourced from third-party retail listings and is subject to the availability and accuracy of those sources.
• PricePress does not control the pricing set by retailers and cannot guarantee that any specific retailer or product listing will be available at the time of query.
• The routing of queries to specific data providers is determined by our Proprietary Retail Routing engine and may change without notice as we optimise for accuracy and coverage.
• Cached pricing results may be served for frequently queried items to improve performance, subject to cache freshness policies. Cached results include a timestamp reflecting the date the price was originally verified from a live retail source, which may predate the date of your query. This timestamp constitutes a forensic point-in-time record of market pricing.

7. Intellectual Property

The Service, including its Proprietary Retail Routing technology, Market-Value Consensus Engine, categorisation logic, and all associated software, is the intellectual property of PricePress. You may not reverse engineer, decompile, or attempt to extract the source code or routing logic of the Service. Your claim data and uploaded content remain your property.

8. Disclaimer of Third-Party Data Accuracy and Pricing Outputs

PricePress acts as an automated routing engine that aggregates pricing information from third-party APIs and public retail sources. PricePress Ltd does not guarantee the accuracy, completeness, or currentness of any prices, product matches, or data provided. The quality and accuracy of all pricing outputs is materially dependent on the quality of the item descriptions, brand names, model numbers, quantities, and other data entered by the User. The User is solely responsible for ensuring that all input data is accurate, complete, and appropriate for the intended claim. PricePress accepts no responsibility for pricing outputs that are inaccurate, misleading, or otherwise unsuitable as a direct or indirect result of incomplete or erroneous User-supplied data.

The User acknowledges that they are a licensed professional and assumes sole responsibility for reviewing, verifying, and approving all Replacement Cost Values (RCV), Actual Cash Values (ACV), depreciation figures, product matches, and all other data outputs before submitting them to any carrier, client, court, insurer, or third party. The Service and all data are provided strictly on an "AS IS" basis.

9. Match Strength Indicators

The Service assigns match strength indicators (such as "High", "Medium", or "Low") to priced items based on factors including the number of comparable retail results found and the consistency of pricing across those results. These indicators are algorithmic estimates provided for workflow prioritisation only. They do not constitute a guarantee of pricing accuracy and should not be treated as a substitute for professional review. A "High" match strength indicator does not mean the price is correct — it means the automated system found consistent market data. The User remains solely responsible for verifying all prices regardless of the match strength indicator assigned.

10. Disclaimer of AI-Generated Outputs

The Service includes artificial intelligence features including, without limitation, AI Claim Review and AI Auto-Categorisation ("AI Features"). These AI Features are provided as assistive workflow tools only. They are not a substitute for the professional judgement, independent verification, or legal obligations of the User. PricePress Ltd makes no representation or warranty of any kind, express or implied, as to the accuracy, completeness, reliability, fitness for purpose, or correctness of any output produced by the AI Features.

In particular:

• AI Claim Review flags are generated heuristically and may contain false positives or false negatives. Flags do not constitute a finding of fraud, error, or impropriety. The User must independently assess every flagged item before acting on any AI-generated flag.
• AI Auto-Categorisation assigns categories probabilistically based on item descriptions. Category assignments may be incorrect and will directly affect depreciation calculations and pricing source routing. The User must review and confirm all AI-assigned categories before running the pricing engine or submitting any claim output.
• No AI-generated output from the Service constitutes professional advice, a legal opinion, an insurance assessment, or a claims determination of any kind.

The adjuster or authorised professional using the Service bears sole and exclusive responsibility for reviewing, validating, and approving all AI-generated outputs prior to use, submission, or reliance. PricePress shall not be liable for any claim denial, regulatory action, professional sanction, client dispute, or loss of any kind arising from reliance on AI-generated outputs without independent professional verification.

11. Disclaimer of Warranties and Liability

The Service provides estimated retail pricing based on third-party live data sourced from External Retail Aggregators and Third-Party Market Data Providers. PricePress does not guarantee the absolute accuracy, completeness, or currentness of any generated prices.

The User assumes all responsibility for verifying the final figures submitted to insurance carriers, courts, clients, or any third party. In no event shall PricePress be liable for denied claims, rejected valuations, lost revenue, regulatory penalties, or damages of any kind arising from the use of pricing data or AI-generated outputs produced by the Service.

12. Waiver of Consequential Damages

Under no circumstances shall PricePress be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, loss of business, loss of data, or rejected insurance claims, even if PricePress has been advised of the possibility of such damages.

13. Limitation of Liability

To the maximum extent permitted by applicable law, the total cumulative liability of PricePress, its directors, and affiliates, for any claims arising out of or relating to these Terms or the Service, shall not exceed the total amount paid by you to PricePress for the Service during the twelve (12) months immediately preceding the event giving rise to the liability.

14. Compatibility with Estimating Software

PricePress may offer export formats designed for compatibility with Industry-Standard Claims Software and Major Estimating Platforms. PricePress is not affiliated with, endorsed by, or officially integrated with any such third-party estimating platform unless explicitly stated. Compatibility features are provided on a best-effort basis.

15. Force Majeure

PricePress shall not be liable for any failure or delay in providing the Service caused by circumstances beyond its reasonable control, including but not limited to: failure or unavailability of third-party APIs, data providers, or retail aggregators; internet or network outages; acts of God; government action; or any other force majeure event. PricePress will endeavour to restore the Service as soon as reasonably practicable following any such event.

16. Account Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may request a data export in CSV or XLSX format by contacting support prior to or within 30 days of termination. Export requests will be fulfilled within 30 days where technically practicable.

17. Governing Law and Exclusive Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Jersey, Channel Islands. You irrevocably agree that the courts of Jersey shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or your use of the Service.
